1. Acceptance of Terms

By accessing or using ProseShift ("the Service"), available at proseshift.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. You must be at least 16 years of age to use ProseShift.

2. Service Description

ProseShift is an AI-powered text humanization and scoring tool. The Service uses large language models to rewrite AI-generated text and provides real-time scoring metrics (perplexity, burstiness, style variation) to analyze how detectable text may appear to AI detection tools. ProseShift is provided as a writing assistance tool to help users improve the naturalness and quality of their content.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• One account per person. Multiple accounts are not permitted.
• You must notify us immediately of any unauthorized access to your account.

4. Plans and Pricing

4.1 Free Plan

• 5 text humanization requests per month
• English language only
• Basic scoring features

4.2 Pro Plan (€9/month)

• Unlimited humanization requests
• 6 languages (English, Italian, Spanish, French, German, Portuguese)
• A/B model testing
• All writing styles and intensity levels

4.3 Agency Plan (€29/month)

• Everything in Pro
• Batch processing
• API access (when available)
• Priority support

4.4 Billing

• Paid plans are billed monthly via Stripe.
• Prices are in EUR and may be subject to applicable taxes.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You can cancel or change your plan at any time through the customer portal.
• Refunds are not provided for partial billing periods. Upon cancellation, you retain access until the end of the current billing period.

5. Acceptable Use Policy

You agree not to use ProseShift to:

• Generate, process, or distribute illegal content
• Create or distribute malware, spam, or phishing content
• Impersonate any person or entity
• Engage in automated scraping, crawling, or unauthorized API access
• Resell or redistribute the Service without an Agency plan
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or its infrastructure
• Circumvent usage limits or access controls

6. Academic Integrity Disclaimer

ProseShift is a writing assistance tool designed to help users improve the naturalness and readability of their content.

We do not endorse, encourage, or condone the use of ProseShift to:

• Submit AI-generated work as your own original work in academic settings
• Violate your educational institution's academic integrity or honor code policies
• Deceive instructors, examiners, or academic evaluators
• Circumvent plagiarism detection or academic integrity systems for dishonest purposes

You are solely responsible for how you use the outputs generated by ProseShift. You must comply with all applicable academic integrity policies, codes of conduct, and institutional rules. ProseShift accepts no liability for any academic misconduct, disciplinary action, or consequences resulting from the misuse of this Service.

7. AI Detection Disclaimer

ProseShift provides scoring metrics and text humanization on an "as-is" basis. We make no guarantees that:

• Humanized text will pass any specific AI detection tool
• Scoring results will match those of external AI detectors
• The Service will produce consistent results across all content types

AI detection technology evolves rapidly. Detection tools update their algorithms regularly, and results may vary depending on content, length, language, and the specific detector used. Our scoring engine provides an estimate based on known detection metrics, not a guarantee of undetectability.

8. Intellectual Property

• Your content: You retain full ownership of any text you input into or receive from ProseShift. We do not claim any intellectual property rights over your input or output text.
• Our service: The ProseShift brand, logo, website design, source code, scoring algorithms, and all related intellectual property are owned by ProseShift and protected by applicable intellectual property laws. You may not copy, modify, or redistribute any part of the Service without our written permission.

9. Privacy

Your use of ProseShift is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Our total liability to you for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
• In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, reputation, or goodwill.

11. Indemnification

You agree to indemnify, defend, and hold harmless ProseShift and its owner from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to or generate through the Service

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree with the modified Terms, you must stop using the Service.

13. Termination

• We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice.
• You may delete your account at any time by contacting us.
• Upon termination, your right to use the Service ceases immediately. Data deletion will be handled per our Privacy Policy.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Italy, without regard to conflict of law principles.

If you are a consumer residing in the EU, you also have the right to submit disputes to the EU Online Dispute Resolution platform.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
